Please read these terms of service carefully (“Terms”) – they are a legal contract between you and HOMEiZ A Media Group LLC (“HOMEiZ A Media Group LLC” or “we” or “our” “the site”) which govern your use of www.HOMEiZ.com (the “Site”) an online listing/advertising platform for different types of Real estate, Vacation Homes, Event Venue and related services available via the Site.
ALL USERS must be at least (18) years of age to use this website. By using this website and by agreeing to these terms and conditions you warrant and represent that you are at least (18) years of age.
Who we are
HOMEiZ is, Real estate Media & Technologies. We are the Real estate Social Network /Real estate listings and search portal, oriented service that operates via website.Founded on February 25, 2015,and launched on May 3, 2017, it is mainly used for professional real estate networking, including posting listings and real estate buyers,sellers and investors.
HOMEiZ allows members both, real estate professionals and consumers to create profiles and "connections" to each other in an online social network which may represent real-world real estate professional relationships. Members can invite anyone whether an existing member or not to become a connection. The connection gated-access approach where contact with any professional requires either an existing relationship or an introduction through a contact of theirs is intended to build trust among the service's members. HOMEiZ is headquartered in Agoura hills, California.
1. Using or accessing HOMEiZ.com
2. Responsibility for applicable laws, rules and regulations:
Users agree that they are responsible for, and agree to abide by, all laws, rules and regulations applicable to their use of the Site, their use of any tool, software, service or product offered on the Site and any transaction they enter into on the Site or in connection with their use of the Site. All paid Members and or non-paid members and or all users further agree that they are responsible for all content advertised in our website and agree to abide by all laws, rules and regulations applicable to the advertising/ listing of their sale/rental/lease property and the conduct of their sale/rental/lease business, including but not limited to any and all laws, rules, regulations or other requirements relating to taxes, credit cards, data and privacy, taxes, permits or license requirements, zoning ordinances, safety compliance and compliance with all anti-discrimination and fair housing laws, as applicable. Please be aware that, even though we are not a party to any sale/rental/lease and advertising transaction and assume no liability for legal or regulatory compliance pertaining to sale/rental/lease properties listed on the Site, or advertise in our website ,there may be circumstances where we are nevertheless legally obligated (as we may determine in our sole discretion) to provide information relating to your Advertising/listing/Banner advertising in order to comply with governmental bodies in relation to investigations, litigation or administrative proceedings, and we may choose to comply with or disregard such obligation in our sole discretion.
3. Limited License to Use the Site.
Users are granted a limited, revocable, non-exclusive license to access the Site and the content and services provided on the Site solely for the purpose of advertising their businesses or and a property for sale/rent /lease/vacation Homes/Event Venue or long term lease property or short term rental property, searching for a property, clearly stated on a Site, all in accordance with the Terms. Any use of the Site that is not for one of these purposes or otherwise in accordance with the Terms or as otherwise authorized by us in writing is expressly prohibited.
4. Unauthorized Uses of the Site.
Any commercial use (other than by members with a fully paid up subscription in good standing (a “valid paid subscription”) or by members pursuant to a valid license to software offered on a Site (a "valid license") of the Site or any content on the Site;
Copy, reproduce, upload, post, display, republish, distribute, or transmit any part of the content in any form whatsoever;
Reproduce any portion of the Site on your website or otherwise, using any device including, but not limited to, use of a frame or border environment around the Site, or other framing technique to enclose any portion or aspect of the Site, or mirror or replicate any portion of the Site;
Deep-link to any portion of the Site without our express written permission;
Modify, translate into any language or computer language, or create derivative works from, any content or any part of the Site;
Reverse engineer any part of the Site;
Sell, offer for sale, transfer, or license any portion of the Site in any form to any third parties;
Use any robot, spider, scraper, other automatic device, or manual process to monitor, copy, or keep a database copy of the content or any portion of the Site;
Use the Site and its inquiry functionality other than to advertise and/or research properties for sale/ for rent/ for lease, vacation rentals, events venue, make an offer/counteroffer to make legitimate inquiries to our members or any other use expressly authorized on the Site;
Use the Site or post or transmit information that is in any way false, fraudulent, or misleading, false pretenses, or taking any action that may be considered phishing or that would give rise to criminal or civil liability;
Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic or profane material;
Violate, plagiarize or infringe the rights of us or third parties including, without limitation, copyright, trademark, patent, trade secrets, rights of publicity or privacy or any other intellectual or proprietary rights; or Use or access the Site in any way that, in our sole discretion, adversely affects or could adversely affect the performance or function of the Site or any other system used by us or the Site.
5. Proprietary Rights and Downloading of Information from the Site.
The Site and all content and information on the Site are protected by copyright as a collective work and/or compilation, pursuant to applicable U.S. copyright laws and conventions and database rights. You agree to abide by any and all copyright notices, information, or restrictions contained in or relating to any content on the Site. Copying, storing or otherwise accessing the Site or any content on the Site for other than for your personal, noncommercial use (other than in accordance with a valid subscription) is expressly prohibited without prior written permission from us.
Each user acknowledges and agrees that, regardless of such user’s physical location, we may store and process any data transmitted to the Site from such user at locations both within and outside of the United States.
In the event that you use any of our tools that we may from time to time offer that integrate in any way with a third party website to which you have provided data or information, you acknowledge and agree that such third party website shall be responsible for how the data or information you have provided to such website is handled.
7. Identity Verification.
User verification on the Internet is very difficult and we cannot, and do not assume any responsibility for, the confirmation of each user's purported identity. We encourage you to communicate directly with any member through the tools available on the Site, though even this does not assure you of the identity of the person with which you are communicating. We further encourage you to take other reasonable measures to assure yourself of the other person’s identity.
You agree to: keep your password and online ID for both your account with us and your email account secure and strictly confidential. If unauthorized person is accessing your account, please notify us immediately and select a new online ID and password if you believe your password for either your account with us or your email account may have become known to an unauthorized person, please notify us immediately if you are contacted by anyone requesting your online ID and password. Further, if we suspect any unauthorized access to your account, upon our request, you agree to promptly change your ID and password and take any other related action as we may reasonably request.
We discourage you from giving anyone access to your online ID and password for your account with us and your email account. However, if you do give someone your online ID and online password, or if you fail to adequately safeguard such information, you are the only responsible for any and all transactions that the person performs while using your account with us or your email account, even those transactions that are fraudulent or that you did not intend or want performed.
8. Limitations on Communications and Use of Other Users’ Information; No Spam.
You agree that, with respect to other users' personal information that you obtain directly or indirectly from or through the Site, transaction or software, we have granted to you a license to use such information only for:
(A) Site-related communications that are not unsolicited commercial messages,
(B) using services offered through the Site, and
(C) inquiring about or otherwise facilitating a financial transaction between you and the other user related to the purpose of the Site. Any other purpose will require express permission from the user. You may not use any such information for any unlawful purpose or with any unlawful intent.
In all cases, you must give users an opportunity to remove their information from your address book or database or other records and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this provision, if you disclose personal information about another user to any third party without both our consent and the consent of the other user. You agree that other users may use your personal information to communicate with you in accordance with this provision. Further, you agree that you will protect other users’ personal information with the same degree of care that you protect your own confidential information using at minimum a reasonable standard of care, and you assume all liability for the misuse, loss, or unauthorized transfer of such information.
9. Responsibility for Property Listings, Reviews and Other User Contributed Content; Participation in Interactive Forums.
We have no duty to pre-screen content posted on the Site by ALL members or and any other professionals who are using the Site or any other users, using (HOMEiZ) website whether directly contributed by the user or contributed by us or a third party on behalf of the user (including, without limitation, property listings, reviews, participation in an interactive community, Community forum or blog (each an “Interactive Community Forum”) or any other content provided by a user to the Site), (collectively, “user contributed content”). We are not responsible for user contributed content. “User contributed content” also includes information that a user or any other person provided to a third party website or mobile application which is then provided to our Site by a tool we offer or any other exchange of user contributed content we have authorized.
We reserve the right to decline to permit the posting on the Site of or to remove from the Site any user contributed content that fails to meet our Content Guidelines any other guidelines posted on a Site or if it otherwise violates these Terms, each as determined in our discretion. We may also remove user contributed content if it is brought to our attention, such as by notice given to us by a user or any third party that any part of these Terms, or any other requirements governing the posting of such content, has/have been apparently breached in respect of such content, as determined in our consent. We reserve the right, but do not assume the obligation, to edit a member’s content or user contributed content in a non-substantive manner solely to cause the content to comply with our content guidelines or formatting requirements or to provide services to members to create or improve on listings in accordance with information we have about the property listed. Users remain responsible for reviewing their user-contributed content to ensure it is accurate and not misleading.
At a minimum, user contributed content must:
Not infringe anyone's rights, violate the law or otherwise be inappropriate;
Not include personal information of another that can be used to identify or contact any person;
Not include unsolicited promotional content, advertising, political campaigns, contests, raffles or solicitations;
Be directly related to the Site, business service, product or forum where the content is submitted;
Not be obscene, abusive, discriminatory or illegal content; or
Not be false or misleading.
Property Listings: All property listings on the Site are the sole responsibility of the member (who may be the owner or a property manager or duly authorized property manager or the real estate agent of the owner) and we specifically disclaim any and all liability arising from the alleged accuracy of the listings, reviews, prices, price opinions, banner advertising or any alleged breaches of contract on a user's part.
All Members are solely responsible for keeping their property information up-to-date on the Site, including, but not limited to any and all representations about any property, its statues, amenities, location, price, and its availability for a specific date or range of dates if for sale or rent or lease. We do not represent or warrant that any of the copy, content, property reviews, property location, suitability, pricing or availability information published on the Site is accurate or up-to-date even in the case where prospective users have searched for specific special offers, dates, or types of properties. We may from time to time provide or facilitate services to Members to create or improve the quality of their property listings. We also may from time to time create new or otherwise change the location or geographic descriptions we use to identify properties in their listings and search results. Consequently, we may change the location or geographic description associated with any property listing at any time without notice. However, we assume no responsibility to verify property listing content or the accuracy of the location. All Members with no exceptions are solely responsible for ensuring the accuracy of location, geographic and other content and location or geographic descriptions and agree to promptly correct any inaccuracy ALL paid members and non-paid members are solely responsible for verifying the accuracy of such content and descriptions.
Responsibility for All Other User Contributed Content: All other user contributed content is the sole responsibility of the user who contributed such content, whether such user contributed the content directly or through a third party website. All Users are solely responsible for their user contributed content and we specifically disclaim all liability for user contributed content.
The user represents and warrants that the user owns or otherwise controls and have all legal rights to the user’s submission and the name or other identifier used in connection with such submission including, but not limited to, all the rights necessary to provide, post, upload, input or submit the user contributed content. We reserve the right to request a proof of ownership of any property listed in HOMEiZ.com or and a permission from the property owner to list the property in HOMEiZ.com and to refuse to post user generated content without such proof or if such proof is, in our sole discretion, insufficient.
License and Rights Granted to Us: By submitting or authorizing user contributed content, you grant to us and our, irrevocable, unrestricted, non-exclusive, royalty-free and fully paid-up license to use, copy, license, sublicense (through multiple tiers), adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise exploit the copy, the photographs and the likenesses (if any) of any of your user contributed content, in connection with our business or the business of our affiliates. Notwithstanding the foregoing, following the termination or expiration of a property listing subscription, we will not continue to display the user contributed content that was displayed in such listing.
You further grant us the ability to copyright and protect the user contributed content, including the images, copy, and content available via any member’s listing, from the unauthorized use by unaffiliated third parties who may, from time to time, attempt to pirate such information via electronic or other means. This includes, but is not limited to, the right to file suit to seek injunctive relief to protect such material. You further agree to assist us at our expense and control to protect such copyrighted material from unauthorized redistribution.
You agree that we may sublicense all the rights granted to us under these Terms to one or more third parties we may contract with to display all or part of the member’s property listing or otherwise provide promotional or other services related to our business.
Further, each member agrees that we may reproduce in whole or in part any photographic material supplied by such member in the promotion of either such member’s property or the promotion of the Site.
In the event that it is determined that you retain any rights of attribution, integrity or any other moral rights in any user contributed content, you hereby declare that you do not require that any personally identifying information be used in connection with the user contributed content or any derivative works thereof and that you have no objection to the publication, use, modification, deletion or exploitation of the user contributed content by us or our affiliates.
10. HOMEiZ Members Service Fees
HOMEiZ charges a service fee for anyone who is looking to use HOMEiZ website services for add a featured listing, professional banner advertising, buyer banner advertising. Our Service Add a Standard listing is free of charge. Our Service in add listings are: upload photos, upload documents, Upload Comparable sold properties, upload a Virtual, upload a YouTube Video, upload 3D. All listing duration are for 60 days.
The Standard listing limit to upload allowed is Unlimited for 60 days’ duration. The Featured listing is limited to upload only one (1) listing for 60 days’ duration. Using the followings services are free: Make an offer/counteroffer, search all properties, blog, community forum, contact others, submit your price opinion.
Fees and Payments. You agree to pay the featured listing and banner advertising fees and any other charges incurred in connection with your account for a Service at the rates in effect when the charges were incurred. We may have to charge you the State sales tax depending the State you are. We do not accept payments by checks. We will bill all charges automatically to your credit card. Featured listing fees and banner advertising fees will be billed at the beginning of your membership or any renewal. We reserve the right to issue refunds or credits at our sole discretion. If we do issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance and an opportunity to renew or not. You are responsible for any fees or charges incurred to access a Service through an Internet access provider or other Third Party service.
Term; Cancellation and Renewal. This Agreement shall remain in full force and effect while you use the Services. We will not renew automatically your featured listing or standard listing or your banner advertising. If you wish to renew your listings or your banner advertising, you will have the choice to decide if you want to do it. ONCE YOU AGREED AND PAID TO BE A PAID MEMBER, NO REFUNDS OF ANY KIND WILL BE GIVEN! The fees paid for add a featured listing subscription, professional banner advertising, buyer banner advertising, is non-refundable, regardless of whether the subscription is terminated prior to the end of the current billing period.
11. Social Media or Third Party Websites.
If the Site offers a tool or service which allows us to access or use any profile or other information about you that you have provided to Facebook for example or another third party website (each a “Social Media Site”) and you decide to use such a tool or service, you acknowledge and agree that:
(i) The information or content that are a part of your Social Media Site profile, which you have designated as “public” (or a similar designation) (with such information or content and referred to herein as “Social Media Content”) may be accessed and used by us in connection with the Site;
(ii) The Social Media Content will be considered “user generated content” under these Terms and both you and we shall have the same rights and responsibilities as you and we have with respect to user generated content under these Terms;
(iii) In the event that the Social Media Content was for any reason misclassified with a public or similar designation or is otherwise inaccurate or to which you do not agree with for any reason, you agree to work with the Social Media Site to make any changes or resolve any disputes and acknowledge that we will not be able to provide you with recourse; and
12. Language Translations and Maps.
HOMEiZ is using the Google language translate and cannot guarantee the accuracy of the language translation. If any user contributed content created by members or users is translated for display on any Site, we cannot guarantee the accuracy or the quality of such language translation and the member or user is solely responsible for the review, verification and accuracy of such language translation. Unless we specify otherwise to the user or member, any language translation services are offered by us is free of charge.
Maps provided on the Site that are provided by Google are subject to the Google Maps terms and conditions located at:https://www.google.com/intl/en_us/help/terms_maps.html.
13. Currency Convertor.
HOMEiZ is using a third party currency convertor and cannot guarantee the accuracy of currency conversation. User is solely responsible for the, verification and accuracy of such currency conversion.
14. Notification of Infringement; DMCA Policy.
We respect the intellectual property rights of others, and HOMEiZ does not permit, condone, or tolerate the posting of any content on the Site that infringes any person's copyright. HOMEiZ will terminate, in appropriate circumstances, a member who is the source of repeat infringements of copyright. Should you become aware of or suspect any copyright infringement on this Site.
15. Links to Third Party Sites.
This Site may contain links and pointers to other Internet sites, resources, and or sponsors of the Site. Links to and from the Site to other third-party sites, maintained by third parties, do not constitute an endorsement by us of any third parties, the third-party sites or the contents thereof. We may also provide tools to allow interaction between the Site and a third party site, such as a Social Media Site. We are not responsible in any way for such third-party sites or resources and your use of such sites and resources will not be governed by these Terms.
16. Software Available on the Site.
The Site is controlled and operated by HOMEiZ A Media Group LLC, in the United States. Software available on the Site (the “Software”) is subject to United States export controls. No Software available on the Site operated by HOMEiZ A Media Group LLC, in the United States may be downloaded or otherwise exported or re-exported (a) into (or to a resident of any country to which the United States has embargoed goods, or (b) anyone on the United States Treasury Department’s list of Specially Designated Nationals or the United States Commerce Department’s Table of Deny Orders. By using the Site, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
All Software is the copyrighted work of HOMEiZ A Media Group LLC. Your use of such Software is governed by these Terms and the terms of any additional license agreement that accompanies or is included with such Software. If the Software is not accompanied by an additional license agreement, we hereby grant you a limited, personal, nontransferable license to use the Software for viewing and using this Site in accordance with these Terms and for no other purpose.
THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE. COPYING OR REPRODUCING ANY SOFTWARE AVAILABLE ON HOMEiZ.com IS EXPRESSLY PROHIBITED, EXCEPT AS SPECIFICALLY PROVIDED FOR IN A LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE.
17. Unsolicited Ideas and Feedback.
Unsolicited Ideas: From time to time, users may submit to us ideas or suggestions pertaining to our business. We are under no obligation to review or consider them. If you choose to submit any ideas, original creative artwork, suggestions or other works (“submissions”) in any form to us, then regardless of what you say, write or provide to us in connection with your submissions, the following terms shall apply.
The sole purpose of this policy is to avoid potential misunderstandings or disputes in the event that any part of our business, such as our products, website, technologies or marketing strategies, seem similar to any of your submissions. 19. Insurance (Event Venue, Vacation Homes)
Any Venue Owner or Vacation Owner, User understand and agree that it is the Venue Owner’s, Vacation Home owner`s sole responsibility to obtain any insurance as required by the law or otherwise related to any Listings. HOMEiZ A Media Group LLC,is not providing any property insurance of any kind and highly recommends that Venue Owners, Vacation Home owners obtain appropriate insurance for their Venues and Vacation Homes and that each Venue Owner, Vacation Home owner reviews his/her/its policy carefully to confirm that he/she/it understand its terms.
20. Compliance with Law
Venue Owners, Vacation Home owners agree to obtain and maintain all permits and licenses required by any governmental unit or agency and that he/she/it will comply with all applicable laws and regulations related to any rental of a Venue and or Vacation Home or Listings made via the Services.
End User agrees to comply with all laws or regulations required by any governmental unit or agency in the jurisdiction that the Venue or and the Vacation Home is located.
21. Limitation of Liability.
IN NO EVENT WILL HOMEiZ, OR ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, CONSULTANTS, AGENTS AND/OR EMPLOYEES (COLLECTIVELY, THE “HOMEiZ A MEDIA COMPNAY GROUP”), OR ANY THIRD PARTY PROVIDER OF A SERVICE OR TOOL OFFERED ON ANY SITE OF A MEMBER OF THE HOMEiZ A MEDIA COMPNAY GROUP (EACH A “THIRD PARTY PROVIDER”), BE LIABLE FOR ANY LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM (A) OUR SITE, (B) THESE TERMS, (C) ANY BREACH OF THESE TERMS BY YOU OR A THIRD PARTY, (D) USE OF THE SITE, TOOLS OR SERVICES WE PROVIDE, OR ANY THIRD PARTY PROVIDER PROVIDES, RELATED TO THE BUSINESS WE OPERATE ON THE SITE, BY YOU OR ANY THIRD PARTY (E) ANY USER CONTRIBUTED CONTENT, (F) INTERACTION BETWEEN OUR SITE AND ANY THIRD PARTY SITE, INCLUDING WITHOUT LIMITATION A SOCIAL MEDIA SITE, FACILITATED BY A TOOL OR SERVICE ON OUR SITE AND/OR (G) ANY ACTUAL OR ATTEMPTED COMMUNICATION OR TRANSACTION, INCLUDING WITHOUT LIMITATION, ANY PAYMENT TRANSACTION (EVEN IF WE OR ANY THIRD PARTY PROVIDER RECEIVE A COMMISSION OR FEE IN CONNECTION THEREWITH) BETWEEN USERS, IN EACH CASE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6) ANY OTHER CAUSE OF ACTION, TO THE MAXIMUM EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW.
IF YOU ARE DISSATISFIED WITH THE SITE, YOU DO NOT AGREE WITH ANY PART OF THE TERMS, OR HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST US, ANY THIRD PARTY PROVIDER OR ANY USER OF THE SITE WITH RESPECT TO THESE TERMS OR THE SITE, THEN YOUR SOLE AND EXCLUSIVE REMEDY AGAINST US IS TO DISCONTINUE USING THE SITE. IN ALL EVENTS, OUR LIABILITY, AND THE LIABILITY OF ANY MEMBER OF THE HOMEiZ A MEDIA COMPNAY GROUP, TO YOU OR ANY THIRD PARTY IN ANY CIRCUMSTANCE ARISING OUT OF OR IN CONNECTION WITH THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO US IN THE TWELVE MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY OR (B) $150.00 IN THE AGGREGATE FOR ALL CLAIMS.
THE SITE, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SITE, IS PROVIDED "AS IS." 23. Disputes; Arbitration.
HOMEiZ is committed to customer satisfaction! Should you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section.
Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, our subsidiaries, users or any companies offering products or services through us (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Terms, regardless of whether prior versions of the Terms required arbitration.
Arbitrations will be conducted by the chosen persons agreed by both parties. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to “HOMEiZ.com at HOMEiZ A Media Group LLC 28719 Aries St Agoura Hills, Ca 91301. If we request arbitration against you, we will give you notice at the email address or street address you have provided.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action.
If for any reason a Claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.
24. Responsibility for Property and Liability.
We do not provide liability insurance protection for Homeowners, property managers, Real estate agents/brokers, or travelers; regardless of whether a user obtains insurance coverage through one of our third party providers. Users are solely responsible for obtaining insurance coverage sufficient to protect their properties and guests or their (Vacation Homes) (Events) as applicable. Further, Members agree to provide us with copies of relevant proof of coverage upon our request.
25. Member Eligibility; Accuracy of Information; Representations.
In addition to being bound by the Terms set forth above, members who purchase subscriptions to advertise a property on HOMEiZ Site are also bound by the following terms, which are in addition to any other terms agreed to in connection with purchasing or renewing a subscription.
Our services may only be used by members who can form legally binding contracts under applicable law. If you are registering as a business entity, you represent that you have the authority to bind the entity to these Terms. Each member represents and covenants that all information submitted to us and to our Site during such member’s registration with the Site shall be true and correct. Each member further agrees to promptly provide notice to the Site by contacting us as provided above under “General – Contact Us” regarding any updates to any such contact information previously submitted by such member to the Site. Each member agrees to promptly provide such proof of personal identification, proof of ownership of the property listed on the Site, and proof of authority to list the property as we may request. Each member further represents and covenants that: (i) it owns and/or has all necessary rights and authority to offer for sale, lease, rent the property listed by such member. All members will not fail to disclose a material defect in, or material information about, any property for sale, lease, rent and will upon request, or otherwise from time to time, review the property listing content and location or geographic description to ensure it is accurate and not misleading; (iv) that it will not wrongfully deny access to the listed property; Upon our request, each member agrees to promptly provide to us such proof of personal identification associated with the property are accurately described in the listing, proof of ownership of the property listed on the Site, and/or proof of authority to list the property as we may request.
26. Listing Appearance in Search Results.
We cannot guarantee that your listing will appear in any specific order in search results on a Site. Search order will fluctuate based on a variety of factors such as search parameters, subscription level purchased, listing quality, how frequently a calendar is updated, (Vacation Homes) and (Event Venue) and other factors that we may deem important to the user experience from time to time. Listing appearance or order in any particular search result may also vary depending on the search criteria used by the particular user. HOMEiZ A Media Group LLC, reserves the right to apply various search algorithms or to use methods to optimize results. Search results and sort order may appear different on HOMEiZ’s mobile application than they appear on the Site. To optimize the search experience for both members and travelers, HOMEiZ retains the right to run occasional tests that will be limited in duration but may alter how we display search results.
27. Content, Layout and Copy.
All content and copy edits submitted by HOMEiZ members are subject to review and approval by us in our sole discretion. We reserve the right to refuse to publish any content that we determine in our sole discretion does not meet these Terms or is otherwise unacceptable to us. However, we assume no duty to review content and we shall not have any liability for any loss or damage resulting from the design or positioning of the copy, properties, content and/or photographs or any change made to any content, photograph or copy submitted by any member. All content must meet our Guidelines Terms. We reserve the right to edit content submitted to the Site in a non-substantive manner solely to cause the content to comply with our content guidelines or formatting requirements. Members are responsible for reviewing and ensuring that any content displayed on the Site appears as the member intended.
28. Uploading Photographs.
Photographs should depict the sale, lease, rent and Vacation Homes rentals as the main subject of the photograph and may not include children or adults if you do not have their legal consent or any information that would violate the privacy rights, intellectual property rights or any other rights of a third party. ALL Photographs must meet our CONTENT GUIDELINES. We reserve the right not to display or to remove any photographs that we determine, in our sole discretion, do not meet these Terms or are otherwise unacceptable to us. HOMEiZ keeps the right to insert its name HOMEiZ on each and every photo uploaded to our site.
By submitting a photograph to us, the member represents and warrants that (a) (i) it holds all intellectual property rights with respect to each submitted photograph, or (ii) it has secured from the copyright holder all rights necessary for the photograph to be used in an online advertisement, (b) that any people in the photograph have given permission for their likeness to be displayed in an online advertisement on the Site, (c) that the photograph accurately and fairly represents the subject of the photograph and has not been altered in any manner that would mislead a viewer of that photograph, and (d) that it will indemnify and hold harmless the Site and any member of the HOMEiZ A Media Group LLC, from any cause of action arising from any misrepresentation with respect to any and all photographs so submitted.
It is the member’s responsibility to obtain reproduction permission for all photographic and other material used in its listings. The member warrants that it is the owner of the copyright in such material or is authorized by the owner thereof to grant to us the rights therein contained and agrees to provide any proof of such rights to us that we may request.
Further, each member agrees that we may reproduce in whole or in part any photographic material supplied by such member in the promotion of either such member’s property or the promotion of the Site.
29.Uses of Our Trademarks or Logos.
There are limited ways in which you may use HOMEiZ`S trademarks or logos without specific prior written authorization. These are the general guidelines: It is usually permissible for you to refer to HOMEiZ which you list your property in a descriptive manner in your listing on the Site or in other permissible communications. For example, you might say "Look out my listings on HOMEiZ," or "I list my properties on HOMEiZ ." However, you may not refer to HOMEiZ in any way that might lead someone to believe or think that your company or site is sponsored by, HOMEiZ, or endorsed by HOMEiZ. For example, you may not say “HOMEiZ sponsors my listings for sale/rent/lease). You may not use our name HOMEiZ on any other website that lists properties for sale/rent/lease/vacation rentals without prior written authorization from us.
The HOMEiZ name and logo is registered trademarks in the United States and other jurisdictions around the world. We generally do not permit the use of our name and logo, other than as described above or with our prior written authorization from us.
30. Hypertext Links.
HOMEiZ A Media Group LLC, reserves the right to refuse hypertext links to, or addresses of, other web sites from members' pages, and to remove links or web addresses without notice at our sole discretion. Further, we reserve the right to charge for hypertext links at any time.
31. Advertising More Than One Property.
Each listing must relate to an individual and uniquely identified Member/Property.
The property in a listing may not be substituted for another property legally listed by the same member.
All Paid members can submit changes to an existing listing that was approved.
All Paid members can upload listings that THEY legally PERMITTED to do so or legally belong to them. All members who upload a listing should have his/her own contact information and not others contact information. Only one property at the time can appear on each listing. We reserve the right to amend the copy or remove any listing when more than one property is described in such listing.
32. Payment Methods; Featured listing Payment, Banner Advertising Payment; Automatic Renewal of membership Subscription Payments.
Payments for Featured listing subscriptions: Payment for featured listings and or banner advertising must be made to us in U.S. Dollars paid either by major credit or debit card only. (See payment options)
No Automatic Renewal for Listings and or Banner advertising: For any subscription paid for by credit card, such subscription shall not be automatically renewed. It will be the user choice to renew it or not.
33.. Subscription Term, Refund Requests and Cancellation or Transfer of Listings.
Listing Term: A Standard (free) listing is good for 30 days’ duration only. The featured listing (paid) is good for 60 days’ duration only.
Refund Requests: Refund Requests: No refunds will be given after payment was made. If you renew your featured (paid) listing, or your banner advertising, your listing or and your banner advertising will remain online for the entire subscription period without any refund. If you sell your property and no longer wish for the listing to remain online, please contact us and we can remove the listing; however, no refund will be owed. Your listing will be removed after 30 (free listing) days 60 days (paid listing, featured) automatically if you wish not to renew your listing or your banner advertising.
We have the Right to Terminate a Listing: If, in our sole discretion, any user submits unsuitable material to our Site or into our database, misuses the Site or our online system or is in material breach of these Terms, we reserve the right to terminate such member’s subscription(s) immediately without any refunds. In addition, if we become aware of or receive a complaint or a series of complaints from any user or other third party regarding a member’s listing in our sole discretion, warrants the immediate removal of such member’s listing from the. If we determine or suspect that the member’s payment-related practices or procedures are not secure, legal or otherwise proper, or if we receive a complaint that any listing’s content infringes on the rights of a third party), then we may immediately terminate such member’s listing(s) or subscription(s) without notice to the member and without any refunds. We assume no duty to investigate complaints. Finally, if any member is abusive or offensive to any employee or representative of the HOMEiZ A Media Group LLC, we reserve the right to terminate such member’s listing(s) or subscription(s) immediately without any refunds. Finally, if any member is in breach of these Terms or its obligations to us or any of our third-party providers then we may terminate such member’s subscription(s) immediately without notice to the member and without any refunds.
Transfer of Listing to a Third Party: No listing may be transferred to another party unless the owner of that property chooses a different representative. We reserve the right to see a proof of such or if we believe that the same property is listed by two different members this listing will be removed immediately without any refunds.
34. Distribution of Listings to Third Party Websites.
To enable Members to obtain broader distribution of their properties, we may provide your listing information, or otherwise provide for the distribution of, your listing on a Third Party Website. Additional terms and conditions may apply to such distributions, as we may notify you of via your online account or email.
35. No warranties
This website is provided “as is” without any representations or warranties, express or implied. HOMEiZ.com makes no representations or warranties in relation to this website or the information and materials provided on this website.
Without prejudice to the generality of the foregoing paragraph, HOMEiZ.com does not warrant that:
this website will be constantly available, or available at all; or
the information on this website is complete, true, accurate or non-misleading.
Nothing on this website constitutes, or is meant to constitute, advice of any kind. (If you require advice in relation to any) (legal, financial or in any other profession) matter you should consult an appropriate professional.

You own all of the content and information you post on HOMEiZ.
For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission: You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with HOMEiZ (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
1: When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
2: When you use an application, the application may ask for your permission to access your content and information as well as content and information that others have shared with you. We require applications to respect your privacy, and your agreement with that application will control how the application can use, store, and transfer that content and information. When you publish content or information using HOMEiZ it means that you are allowing everyone, including people off of HOMEiZ, to access and use that information, and to associate it with you (i.e., your name and profile picture).
3: We always appreciate your feedback or other suggestions about HOMEiZ, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).
4: You hereby agree to give us the permission to put our name HOMEiZ as a watermark on all property photos you may upload to the site that we can identify the listing you uploaded in HOMEiZ in case of scraping the listing by someone else and uploaded on a different site.
42. Adding other Real estate agents to your own listing
HOMEiZ gives the listing agent the freedom to add other licensed real estate agents to their own listing. Licensed real estate agents who will want to get an exposure to their brand and business, can negotiate a price directly with the listing agent for appearing in a listing. HOMEiZ lets the listing agent to make this revenue. It is your listing it is your decision. This feature allowed only to licensed real estate agents who registered into HOMEiZ as licensed real estate agents. Once you have a listing you wish to upload in HOMEiZ, you must choose the featured (paid) listing for 60 days’ duration. If Choosing the standard listing this feature is not allowed. In the tool box under my listings, you have a green button named “Add other licensed real estate agents to your listing” As the listing agent, you can offer your listing space to advertise licensed real estate agents who will want to expose their brand and business in your listing. HOMEiZ allows the listing agent to choose up to 3 other licensed real estate agents to appear on one listing. HOMEiZ lets the listing agent and the licensed real estate agents to negotiate a price between themselves. Once the parties reached an agreement, the other licensed real estate agents should pay directly to the listing agent and not to HOMEiZ. All licensed real estate agents who will choose this great opportunity, must first to register into HOMEiZ and create their own profile for the listing agent to be able adding them into the listing. If from any reason, you wish to remove any of the licensed real estate agents from your listing, you can do it in a click of a mouse. Please note: You may not add unlicensed professionals or anyone who did not give you a permission to do so. In case you added any personal into your listing without his/her permission, HOMEiZ keeps the right to remove your listing from the portal without any refund.
43. Vacation Homes ListingsBefore you list your home for a vacation: Please Note the followings:

Yes, it’s definitely within their power, but the specific answer depends on your association. Venue Owner Content” means all Content that a Venue Owner posts, uploads, publishes, submits or transmits to be made available through the Services, including, but not limited to, Listings. You also represent and warrant that your End User Content will not infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
Event Venue rental rules. Your homeowner's association, city, county, or state/province/ Country may have regulations specifically regarding short-term rentals for an Event. Check with each governing body to find out if there are any rules for minimum stays, fire safety, health code inspections, or permits. Some governing bodies charge steep fines even for the first violation, while others waive short-term rental restrictions for big events, so it's always a good idea to do your research before renting your space for an Event. HOMEiZ will not held any responsibility for any laws you break. It is your responsibility to make sure you are complying with your local laws.
B. Professionals/ Buyers Advertiser/Banner/ Responsibilities.
HOMEiZ A Media Group LLC is allowing in its website/s for self-advertising. Advertiser is solely responsible for all: materials submitted to HOMEiZ.com for inclusion in an Ad, including, without limitation: ad photos, videos, information, URLs, and other content ("Ad Materials"), whether generated by or for Advertiser; and web sites and landing pages to which Ad Materials link or direct users, and the advertised properties and services on such pages, and collectively "Advertised Properties and Services". Advertiser represents and warrants to HOMEiZ A Media Group LLC that it is authorized to act on behalf of and has bound to the terms of this Agreement any third party for which Advertiser Places Ads.
HOMEiZ A Media Group LLC shall, for a period of time as indicated in the corresponding Ad Order (the "Term" or “Subscription Term”), display an Ad including the Ad Materials on www.HOMEiZ.com, and/or other URLs controlled by HOMEiZ A Media Group LLC (the "HOMEiZ A Media Group LLC Sites"), and on websites and applications owned or operated by HOMEiZ A Media Group LLC authorized licensees (the "Licensee Sites") when applicable. HOMEiZ A Media Group LLC shall display any listings and or banner professional Ads on search results pages for areas located in, and within close proximity to, the ZIP code designated by Advertiser, or on other pages on the HOMEiZ A Media Group LLC Site/s or served to users who have visited pages for those ZIP codes. HOMEiZ A Media Group LLC shall display Featured Listing Ads to users whose search queries match the advertised property. All professionals Banners ads display periods are 60-90-120 days. HOMEiZ is charging users based on: Banner type, advertising period, By State, City, Zip code or Nationwide.

You are permitted to use this software only through our website. homeiz.com under a shareware arrangement, you are acquiring a license to use it, not own it. You acquire the license from HOMEiZ company that owns the copyright. The copyright holders for SHAREWARE allow users to use our software for their business transaction but not to distribute copies of the software and modifications to the software are not allowed. Decompiling of the program codes is not allowed. Development of new works built upon this software is not allowed without the permission of the copyright holder.
HOMEiZ created an E-signature within its software/system to be used only for signing an offer/counteroffer. All users must agree to create an account with HOMEiZ and to provide their real email address and password. All users agree that without creating an account in HOMEiZ they are prohibited from using the ``MAKE AN OFFER``/ ``COUNTEROFFER`` User using the make an offer on this property tool or and counteroffer and did not created an account with HOMEiZ, has no claims against HOMEiZ A Media Group LLC and we shall not hold any responsibilities by using this tool. User is the only responsible for in any event that may accrued by using this tool. HOMEiZ A Media Group LLC is not a party to any agreement between sellers, buyers, agents, brokers or and any other professionals participating in the transaction.
H. Professionals participation Program.
HOMEiZ A Media Group LLC lets 6 different professionals Advertisers to participate in a listing. Lenders, home inspections, Escrow companies, Title Companies, Insurance companies, Appraisal companies. These professionals may submit their services on any for sale listing listed in HOMEiZ.com. HOMEiZ A Media Group LLC program understand and agree that there is no relationship between the real estate agent or anyone who submitted a property in HOMEiZ.com and those professionals in such program. The Advertiser will be responsible for paying to HOMEiZ A Media Group LLC and not the listing provider.
J. Payment Terms
All Customers agree to pay for all products ordered through the HOMEiZ website using the payment method indicated, and provides HOMEiZ express authorization to charge said fees to the Customer's payment provider at time of purchase or renewal. Fees owed depend on the specific type of service and quantity of HOMEiZ products, services, information, or deliverables ordered. Payment of fees shall not be contingent on any events other than the delivery of the ordered Deliverables. Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid for by the customer. If payment is not current, HOMEiZ may immediately cease to provide any and all services offered to the customer. The fees do not include sales, use, excise or any other taxes or fees now or hereafter imposed by any governmental authority with respect to the Deliverables. At HOMEiZ`s option, Customer shall pay such taxes or fees directly or pay to HOMEiZ any such taxes or fees immediately upon invoicing by HOMEiZ. HOMEiZ is required to collect sales tax on purchases in select states. Recurring charges will include sales tax in accordance with applicable laws of your state. The fees paid for monthly subscriptions are non-refundable, regardless of whether the subscription is terminated prior to the end of the then-current monthly billing period.

You will need to create an account to use our news feed services.
You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
News feed content share
By submitting, posting or displaying content through the news feed, you grant us a worldwide, non-exclusive, royalty-free license with the right to sub-license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods now known or later developed.
This license authorizes us to make your content available to the rest of the world and to let others do the same. You agree that this license includes the right for HOMEiZ to provide, promote, and improve the services and to make content submitted to or through our services available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such content on other media and services, subject to our terms and conditions for such content use.
Such additional uses by HOMEiZ, or other companies, organizations or individuals, may be made with no compensation paid to you or and to your organization, with respect to the content that you submit, post, transmit or otherwise make available through our services.
You are responsible for your use of the news feed and for any content you provide, including compliance with applicable laws, rules, and regulations. You should only provide content that you are comfortable sharing with others.
Any use or reliance on any content or materials posted via our news feed or obtained by you through our services, is at your own risk.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted in our news feed or endorse any opinions expressed via our news feed and in our services.
We’ll make our best to honor the choices you make about who gets to see your information and content, but we can not guarantee it.
You promise to only provide information and content that you have the right to share, and that your HOMEiZ profile will be truthful. We reserve the right to remove/delete any profiles who seems to be fake.
You understand that by using the news feed services, you may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive.
All content is the sole responsibility of the person who originated such content. We may not monitor or control the content posted via our services and, we cannot take responsibility for such content.
HOMEiZ respects the intellectual property rights of others and expects users of our services to do the same. We reserve the right to remove/delete any content alleged to be infringing without prior notice, at our sole discretion, and without any liability to you. You understand that we may modify or adapt your content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your content in order to adapt the content to different media. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any content that you submit.

By posting content to HOMEiZ, you give us a nonexclusive license to publish it on HOMEiZ Services, including anything reasonably related to publishing it (like storing, displaying, reformatting, and distributing it). In consideration for HOMEiZ granting you access to and use of the Services, you agree that HOMEiZ may enable advertising on the Services, including in connection with the display of your content or other information. We may also use your content to promote HOMEiZ, including its products and content.
You’re responsible for the content you post. This means you assume all risks related to it, including someone else’s reliance on its accuracy, or claims relating to intellectual property or other legal rights.
You’re welcome to post content on HOMEiZ that you’ve published elsewhere, as long as you have the rights you need to do so. By posting content to HOMEiZ, you represent that doing so doesn’t conflict with any other agreement you’ve made.
By posting content you didn’t create to HOMEiZ, you are representing that you have the right to do so. For example, you are posting a work that’s in the public domain, used under license (including a free license, such as Creative Commons), or a fair use.
We can remove any content you post for any reason.
You can delete any of your posts, or your account, anytime. We may keep backup copies of your deleted post on our servers.
Here is a detailed list of prohibited content your should not post in our news feed.
- Any kind of adult product is not permitted on HOMEiZ.
- Dating content and ads on HOMEiZ are not permitted. In no way can you promote adult dating sites.
- Gambling and Lottery promotion materials are not allowed to be post on the news feed.
- Alcohol related content advertising is not permitted.
- Tobacco, drugs, weapons, and pharmaceutical content products cannot be promoted on HOMEiZ.
HOMEiZ ban discrimination outright, both in content and in targeting. Our policy on “personal attributes” expands a little more on what constitutes discrimination. In your news feed posting or and ad, you cannot make any direct or indirect assertions about a person’s:
- Race and/or ethnic origin
- Religion or beliefs
- Sexual orientation or practices, and gender identity
- Disability and/or medical condition (including physical or mental health)
- Financial status
- Membership in a trade union
- Criminal record
You also can't ask people for this kind of information as well as other personal data like Social Security and account numbers. NO: nudity, hate speech, violence, or graphic content,bullying and harassment.
Site users who violate any of these standards are very likely to be remove from the site with no refund.
